1. Introduction
Welcome to Marilu Hayes. These Terms and Conditions govern your use of our online and in person behavioural change services.
2. Acceptance of Terms
By using our services, you agree to these Terms and Conditions.
3. Services
We offer a range of services, including individual behaviour change sessions, individual packages, partner packages, workshops and webinars. These services are delivered through online sessions, phone calls, webinars and in person.
4. Client Responsibilities
You agree to provide accurate information and to follow our guidance. Consult a healthcare provider before starting any new health and wellbeing program.
5. Payment Terms
Our fees are listed on our booking page and are non-negotiable. Payments can be made via debit/credit card, PayPal and bank transfer. Please send all proof of payment, where applicable to info@mariluhayes.com, and use your name or invoice number as reference. Our billing cycle is payment per service.
Refunds are available under the following conditions;

6. Confidentiality and Privacy
We comply with the UK Data Protection Act 2018 and GDPR. Your information is confidential. Please see our Privacy Policy for more details.
7. Cancellation and Termination
You may cancel sessions under the following conditions; Within 48hrs or the 7 day grace period, unsatisfactory services, failure to deliver services, and medical or personal emergencies (please refer to our payment terms). We reserve the right to terminate services under the following conditions; if a client displays inappropriate behaviour, if a client breaks the agreed to terms, if a client does not follow the advice of the specialist and if a client provides false information. Upon termination, all sessions will cease and the client will forfeit their right to a refund.
8. Disclaimers and Limitation of Liability
Our services are not a substitute for medical advice. Results are not guaranteed. Our liability is limited to;
Professional Boundaries
The Consultant provides behavior change coaching and guidance intended to support personal development. The services offered are not a substitute for professional medical, psychological, or legal advice. Clients are advised to seek appropriate professional advice for such matters.
No Guarantees
The Consultant does not guarantee specific results from the coaching sessions. Outcomes may vary based on individual effort and circumstances. No promises or warranties, express or implied, are made regarding the effectiveness of the services.
Client Responsibilities
Clients are responsible for their own health and well-being. They should inform the Consultant of any relevant medical or psychological conditions before beginning the coaching program. Clients are encouraged to consult with healthcare providers before making significant lifestyle changes based on the Consultant's advice.
Limitation of Liability
To the fullest extent permitted by law, the Consultant shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the coaching services, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
Maximum Liability
In any event, the Consultant's total liability for any claim arising out of or relating to the coaching services shall not exceed the amount paid by the Client to the Consultant for the services in the six (6) months preceding the date of the claim.
Insurance
The Consultant maintains professional indemnity insurance to cover claims arising from the provision of coaching services. Clients may request details of this coverage upon request.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Acceptance
By engaging the Consultant's services, the Client acknowledges and agrees to the terms and conditions outlined in this Limitation of Liability clause.
9. Intellectual Property
All content is our property. You may use materials for personal use only.
10. Governing Law and Dispute Resolution
These terms are governed by the laws of England and Wales. Disputes will be resolved through the exclusive jurisdiction of the courts of England and Wales..
11. Changes to Terms
We may modify these terms. You will be notified of changes via e-mail.
